Legal Head, Location : Pune

Hi!



We are from Resources-India Consultants, New Delhi . We are into Executive Search and Selection from Senior to Middle level management.

We have been retained by an MNC in the Engineering and Automation Sector to search a Legal Head, Location : Pune




The candidate should have a 5 yrs LLM degree with 10 yrs experience in contracts management



- Desirable 2 to 3 years' experience as lead of the legal function in a large MNC.



SKILLS / KNOWLEDGE - Sound knowledge and experience in review/analysis of litigations, business agreements, contract terms & conditions, contract administration practices, vis-à-vis local Mercantile Law.



- Understanding of laws and regulations governing business practice in India.



-Outstanding ability to negotiate and represent best interests without being adversarial



- Knowledge in legal risk assessment and risk management



- Relevant experience in process solution industry



- Strong legal acumen with contract negotiation and drafting skill



- Strong legal knowledge will be an advantage

- Maturity/professional attitude



- Ability to integrate contractual obligations with commercial/business needs



- Excellent interpersonal and communication skills



- Fastidious attention to detail



- Ability to adapt to a cyclical work load and to multi-task









PRIMARY FUNCTIONS


The Legal Counsel supports in legal and quasi-legal matters pertaining to business, sales, operation and functional organizations across the business divisions. His functional responsibilities include legal, administration, consulting and/or negotiation of project/service Agreement / Contracts with external customers, development and/or implementation of contract programs, policies and processes. This entails working closely with marketing and sales, operation, functions and business management to structure contracts consistent with the business objectives. The ultimate goal will be to help the businesses achieve maximum performance and profitability through the implementation of well-defined legal process and assessing legal risks and contract management processes and procedures.



RESPONSIBILITIES



The Legal Counsel is responsible for all the legal matters pertaining to consulting, structuring, drafting and negotiation of legal and non-standard project/service contracts with external customers. He/she will also develop and/or implement policies and processes.



The successful candidate will work closely with business teams, other functions, including the legal General Counsel, APAC and teams, external customers. The objectives of increasing customers' orders, improving company's profitability and reducing/avoiding business risk require the successful candidate to:



- increase customer respect and trust by providing creative, customer focused and cost effective legal advise and contract solutions that meet customers' legitimate business needs,



- improve sales force efficiency by taking ownership of legal process and reducing turn around time for litigations and contract drafting, and



- increase company's performance by providing strong legal risk management leadership.



The successful candidate will also be able to:



- identify and minimize legal issues / litigation issues and contractual issues and commercial risks



- implement legal risk assessment and contract management according to policies and processes



- build contract database and provide timely reports on contract metrics and complex legal issues



- ensure the statutory and legal compliances vis-à-vis all applicable local laws and in compliance with business practices and code of conduct



- provide legal and contract management training as required



- provide advise on the legal and quasi-legal matters pertaining to the following:



(a) litigation management

(b) In-house legal opinion on corporate and commercial matters

(c) Labour, IR, HSE

(d) Legal and Statutory Compliances

(e) Real Estate and Leases

(f) Mergers and Acquisition

(g) Various finance and loan documents

(h) Drafting and vetting of various agreement and contracts

(i) Training and development with specific reference to commercial laws and in mercantile laws
